Terms of Service
These terms govern your use of S360 Plot Watch. Please read section 9 in particular: Plot Watch is a screening aid, not a certification or a legal finding.
1. Who we are
S360 Plot Watch (“the service”), available at sat.s360.earth, is operated by S360 Earth Private Limited, a private limited company incorporated in India under the Companies Act, 2013, with its registered office at A102, NCL Sindhu, Petbasheerabad, Qutubullapur, Ranga Reddy, Hyderabad, Telangana 500067 (“S360”, “we”, “us”).
These terms form an agreement between you and S360. By creating an account or using the service you accept them. If you do not accept them, do not use the service. Our privacy notice, refunds and cancellation policy and service delivery policy form part of these terms.
2. Who may use the service
- You must be at least 18 years old and able to enter into a binding contract under Indian law.
- The service is meant for professional and business use, such as supply-chain due diligence, certification preparation and land-use monitoring.
- If you use the service for a company, cooperative, producer group or other organisation, you confirm that you are authorised to accept these terms for it. In that case “you” includes that organisation.
3. Accounts and one-time codes
- You sign in with a one-time code sent to your email address or WhatsApp number. Anyone who can read those messages can sign in to your account, so keep your email and phone secure and do not share codes.
- You are responsible for activity under your account. Tell us promptly at hi@s360.earth if you think someone else has used it.
- Give us an email address and phone number that you control, and keep them up to date.
- One account is for one person. Do not create several accounts to obtain extra free checks.
- We may limit how often codes can be requested, and we may refuse or delay a code where we suspect misuse.
4. What the service does
You upload or draw land-plot boundaries (for example as GeoJSON, KML, Shapefile, Excel or CSV, or WKT) and choose a “Before” date and an “After” date. The service retrieves Copernicus Sentinel-2 satellite imagery for those dates through Microsoft Planetary Computer and produces an automatic vegetation-change screening result for each plot, with a change map, PDF reports and ZIP and CSV exports. Section 9 explains what that result does and does not mean.
5. Your plot data and other people’s data
Files you upload may contain personal data about other people, such as the names of farmers or producers and the locations of their land. For that data, you decide why and how it is used, and S360 processes it on your behalf to provide the service. By uploading any file or drawing any boundary, you confirm that:
- you have the right to upload it and to have it processed by S360 and the providers listed in our privacy notice;
- where it contains personal data about other people, you have a lawful basis to share it with us for this purpose, including any notice or consent required by the Digital Personal Data Protection Act, 2023, and you will deal with requests from those people about their data;
- you upload only the personal data needed for your purpose (plot identifiers often work in place of names); and
- uploading it does not breach any contract, confidentiality duty or law.
You are responsible for the accuracy of the boundaries and dates you submit. Results depend on them.
6. Acceptable use
You must not:
- use the service for anything unlawful, or to harass, track or harm any person;
- upload malware, or files designed to disrupt or overload the service;
- try to gain access to other users’ accounts or data, or to parts of the service not meant for you;
- scrape, resell or provide the service to others as your own product without our written agreement;
- get around credit limits, free-check limits or technical restrictions, including by automated sign-ups;
- present a screening result as a certification, audit opinion, legal determination or statement by S360 that a plot or product is “deforestation-free” or compliant (see section 9); or
- remove or alter attribution notices or disclaimers in reports and exports.
7. Free checks, credits and prices
Free checks
- Each account gets two free checks per calendar month, each on plots of up to 100 hectares. The second free check needs a verified WhatsApp number.
- Unused free checks do not carry over to the next month and have no cash value.
Credits
- After your free checks, checks use prepaid credits, bought in packs through Razorpay (UPI, cards, netbanking).
- A check uses one credit for each started 100 hectares of plot area. For example, a plot of 100 hectares or less uses one credit and a plot of 140 hectares uses two. The number of credits is shown before you confirm a check.
- Credits are valid for 12 months from the date of purchase. Credits not used by then expire and are not refunded.
- Credits are tied to your account. They cannot be transferred, sold or exchanged for cash, except as set out in our refunds policy.
- If a check cannot find a clear image for the dates you chose, the free check or credits it used are returned to your account automatically.
Prices and tax
- Current packs and prices are on our pricing page. Prices are in Indian rupees and exclude GST.
- S360 is registered under GST (GSTIN 36ABUCS6489F1ZG). GST at 18% is added to each purchase: CGST 9% and SGST 9% where the place of supply is Telangana, and IGST 18% elsewhere. The place of supply is taken from the billing state or the GSTIN you give at checkout.
- A GST tax invoice is emailed to you for each purchase and is also available on the Account page. If you want your GSTIN on the invoice, enter it before paying.
- Refunds of paid credits are made with a GST credit note.
- We may change pack prices or the credit rules for future purchases. Changes do not affect credits you have already bought.
8. Refunds
Refunds and cancellations are covered by our refunds and cancellation policy.
9. Screening results and their limits
A Plot Watch result is a screening aid. It is not a legal determination of deforestation, and it is not a finding that any plot, product or organisation complies or does not comply with the EU Deforestation Regulation (EUDR), FSC, PEFC or any other standard or law.
S360 is not a certification body, an accredited auditor or a competent authority, and nothing produced by the service is a certificate, audit opinion or approval. Certification decisions rest with independent certification bodies, and regulatory decisions rest with competent authorities.
Results are produced automatically from optical satellite imagery and can be wrong. Among other things, they can be affected by cloud, haze and shadow; the 10-metre resolution of the imagery; the season and crop cycle; image availability for the dates chosen; and errors in the boundaries supplied. A result showing change does not prove that forest was cleared, and a result showing no change does not prove that it was not.
You should check results with other evidence, such as field visits, records and expert review, before relying on them for any decision, declaration or submission. You are responsible for decisions you make using the service.
10. Ownership and licences
- Your content. You keep ownership of the files and boundaries you upload. You give S360 a non-exclusive, royalty-free licence to store, copy, process and display them, and to send them to the providers listed in our privacy notice, only as needed to provide, secure and support the service for you. This licence ends when the content is deleted, except for copies we must keep by law.
- Your reports. You may use, download and share the reports, maps and exports produced for your account for your own purposes, including sharing them with buyers, certification bodies and authorities, provided you keep the attribution notices and disclaimers in them.
- Our service. S360 and its licensors own the service, its software, design and the “S360” and “Plot Watch” names and marks. These terms do not give you any right to them beyond using the service.
- Feedback. If you send us suggestions, we may use them without any obligation to you.
11. Satellite imagery and other third-party data
- Imagery is Copernicus Sentinel-2 data from the European Union’s Copernicus programme, accessed through Microsoft Planetary Computer. Reports carry the notice “Contains modified Copernicus Sentinel data [year]”. The data is provided by its sources without warranty, and S360 does not control when images are captured or published.
- Base maps and other third-party layers shown in the app remain subject to their own licences and attribution notices.
- The service depends on third-party providers (listed in our privacy notice). We are not responsible for their outages, but we will act reasonably to limit the effect on you.
12. Availability and changes to the service
We aim to keep the service available, but we do not promise that it will be uninterrupted or error-free. We may carry out maintenance, and we may change, add or remove features. If we stop offering the service altogether, we will give at least [30] days’ notice by email where we can, and will refund the unexpired value of paid credits you have not used.
13. Disclaimers
To the extent permitted by law, the service and its results are provided “as is” and “as available”. We do not give any warranty, express or implied, that results are accurate, complete or fit for a particular purpose beyond what is stated in these terms. Nothing in these terms limits any right you have under the Consumer Protection Act, 2019 or any other law that cannot be excluded by contract.
14. Limitation of liability
- S360 is not liable for indirect or consequential loss, loss of profit, revenue, business, goodwill or contracts, or for loss arising from a certification, audit, regulatory or purchasing decision made by you or anyone else, including fines, penalties, rejected shipments or loss of certification.
- S360’s total liability to you arising out of or in connection with the service, whether in contract, tort (including negligence) or otherwise, is limited to the amount you paid to S360 for the service in the 12 months before the event giving rise to the claim.
- These limits do not apply to liability for fraud, wilful misconduct, or any other liability that cannot be limited or excluded under Indian law.
15. Indemnity
You will compensate S360 for reasonable losses, costs and claims made by third parties that result from your breach of section 5 or 6, including claims by people whose personal data you uploaded without a lawful basis.
16. Suspension and closing your account
- You may close your account at any time from the Account page. Closing it erases your plots and checks as described in our privacy notice. Unused credits are lost when the account is closed, so if you think you may be entitled to a refund, ask for it before closing (see the refunds policy).
- We may suspend or close an account, or block particular uploads, if we reasonably believe there has been a serious or repeated breach of these terms, a security risk, fraud, or a legal requirement to do so. Where reasonable we will tell you first and give you a chance to respond. If we close your account without fault on your part, we will refund the unexpired value of unused paid credits.
17. Changes to these terms
We may update these terms. We will show the date of the latest version at the top of this page and, for changes that materially affect you, tell you by email or in the app before they take effect. If you continue to use the service after a change takes effect, the updated terms apply. If you do not accept a change, you may close your account; the refunds policy explains what happens to unused credits.
18. Governing law and courts
These terms are governed by the laws of India. Subject to the next sentence, the courts at Hyderabad, Telangana have exclusive jurisdiction over any dispute arising out of or in connection with them. Nothing in this section prevents you from approaching a consumer commission or other forum that has jurisdiction under the Consumer Protection Act, 2019.
19. Complaints and contact
Please contact us first so we can try to resolve the problem. Complaints can be sent to our grievance officer, [Name to be appointed], at hi@s360.earth or by post to the registered office above. We acknowledge complaints within 48 hours and aim to resolve them within one month. Other contact details are on our contact page.
